Switzerland County Commissioners – Dec 1891

COUNTY BUSINESS.

County Commissioners W. O. Marble, C. D. Green, and George W. Sanders, (succeeding O. A. Potter, term expired, from 3d district,) and Joseph A. Hart, Auditor, met Monday, December 7th, and adjourned last Thursday, 10th. We condense their proceedings as follows:

Licenses to retail liquors were granted as follows: Francis M. Graham, George Kiger, and Frank Scott, Patriot; B. W. Simmons, Vevay.

D. V. Seaver, Recorder elect, filed his bond, which was approved.

A. G. Smith, Attorney General, presented a claim, amount not stated because not known, due tuition school funds, on account of amounts detained and deducted from said funds for salaries and fees. He claims that such deductions have been made from tuition school funds in this county since 1867. By way of explanation, it is not claimed that any illegal fees were charged, but that they should have been paid from general county fund. The County Auditor and County Attorney were ordered to examine into the matter and if they find the claim of the Attorney General correct, then they ascertain the amount due each school corporation, and the Auditor authorized to draw warrants on the general county fund in favor of such school corporations.

In the matter of the claim of Mrs. Jennette Scott Ryan, for damages occasioned by change of highway—Robert Bovard, R. B. Littlefield, viewer, reported her damage $15, which was approved.

Frederick Bakes, (son of John Bakes, Jr.,) appointed students to Purdue University.

William Tait, county treasurer, presented orders redeemed by him for quarter ending Dec. 5th, 1891—county, $10,821.56, school warrants, $11,432.46. Found correct and approved.

A list of allowances made will be found in another column, which in compliance with the law is published in paper having the largest circulation in the county.

GENERAL DOCKET.

John F. McCreary vs. Francis M. Stevenson et al; partition. The deed by Samuel W. Wade, as Commissioner, for sale of lots 112 and 113 in Bela Herrick’s addition to town of Patriot, is ordered corrected—the name of Francis M. Tyrrell, as grantee of said sale instead of Francis M. Tarrell. This done by agreement of all parties.

“Ordered by the Court, that in all Guardianships pending in this county, where the guardian has not made and filed an inventory of the estate of the loan within three months after his appointment, if he shall have been so long appointed, (in accordance with the first division of section 2520 of the Revised Statute of 1881), showing the real and personal estate of his ward, with value thereof, and the value of the yearly rents of the real estate, the Clerk shall issue a citation to such Guardian, requiring him to make an file such inventory on or before the first day of the next term of Court, or then show cause why he has not done so, and should not be removed from his trust. No citation will be issued under this order when it appears from the papers on file that the ward or wards have no estate. Also that all guardians who have not reported for two years shall be cited to appear and report on or before the first day of next term.”

State ex rel Joseph E. Hart, County Auditor, vs. Frank R. Fish, et al; to recover on Congressional School Loan Mortgage. Judgment for $221.08 and foreclosure of mortgage.

Jane A. Gibson vs. Adolpheus E. Merit et al. Abijh S. Humphrey, receiver in above case, presented his report, which was approved. He was also permitted to sell all personal property in his hands at private sale, and report to Court, and authorized to insure tobacco.

Imogene Russell et al vs. Pearl Dyer. Wm. D. Ward, Guardian of Pearl Dyer, allowed $112.79, as balance of her distributive share in sale of real estate, less her share of costs.

Edwin Mead, a petit juror of regular panel, fined $5 for contempt of Court—appearing in Court intoxicated.

George Marshall vs. Sylvia Marshall; divorce. Planitff, George Marshall, restrained from in any way encumbering and disposing of any portion of his property, and case continued until next term.

Louisa M. Slack vs. Ralph R. Stout; slander. Trial by jury; verdict of $1 and damages.

Rosa B. Aldred et al vs. William Miles et al; partition of real estate. Geo. W. McKay, Benjamin N. Davis and David Lee, Commissioners, reported division of lands, which was approved, and partition so ordered.

Lewis H. Dennis vs. Isaac N. Robbins et al; to correct deed and quiet title. Trial by Court; judgment for plaintiff; title to real estate quieted and finding that John Elfers held a lien by note and mortgage for $300.

Caroline J. Tandy vs. William Johnston, Sarah M. Johnston and John Riley; foreclosure of mortgage. Judgment against William Johnston for $250.45 and foreclosure of mortgage.

Court adjourned last Saturday evening.

COUNTY BUSINESS.

The following is a synopsis of business transacted by the County Commissioners at their September term.

In the matter of claim of Mrs. Jennettee Scott Ryan, for $300, on account of change of highway leading from Jacksonville to a branch on Indian Creek—claim not allowed. R. B. Littlefield and Robert Bovard appointed viewers, with reference to amount of damage, to report at December term.

William Tait, County Treasurer, presented orders redeemed by him for the quarter ending Sept. 7th, amounting to $6,127.00. Found correct. He also presented school warrants redeemed by him during last quarter, as follows: Common school, $7.594.07; Congressional school warrants, $220. Found correct.

Daniel Trafelet, Benj. T. Heady and G. W. McKay were previously appointed to view a proposed change of highway from Mennett’s Branch to near Enoch Adams’, in Craig township. Sept. 9 the above viewers reported and recommended the change proposed. The Board ordered the road opened, 30 feet wide; so much of the old road as is effected by the change to be vacated.

The petition of Harvey W. Scranton and others, for bridge over Moredock’s Branch, was continued to next term.

Switzerland and Ohio County Fair – 1891

The Switzerland and Ohio County [Indiana] Fair report appeared in:

NOTES OF THE FAIR.

There were 176 entries of horses at the Fair, several registered horses, thoroughbred horses, and as fine specimens of horseflesh as can be found within fifty miles of this place; some of them came farther.

There were five races, two on Wednesday, known as the three-minute trot and pace. In the trot the time was 2:43; Black Wilkes, owned by David Johnson, 1st money; Charles Banning, owned by Wm. Furnish, 2d money. In the pace, Jerry, owned by Frank Buffington, 1st money; Joe Longfellow, owned by Chas. Sheets, 2d money; time 2:59.

In the trot on Thursday, Bennett, entered by J. A. Works, 1st money; Lillie H., owned by L. E. Stuart, 2d money; time, 2:43. The track was heavy and soft from rain just fallen, else the time might have been much better, perhaps 2:30.

The running race was at the same time and track heavy. One horse, Fred Fisher, owned by B. & J. Blue, fell in this race. Toolem, owned by J. Cunningham, won 1st money; Matonia Bird, owned by Geo. Cook, 2d money; time 58 seconds, one half mile dash.

On Friday, Singer, owned by L. E. Stuart, of Clark county, Ind., 1st money (time said to be 2:29); 2d money, Jerry B., owned by W. M. Shuman.

The exhibit of cattle was not so large as might have been. There were 26 entries, only one herd of short horns, owned by Wm. Bunger & Sons.

Of hogs, there were 26 entries of both large and small breeds. Some fine specimens of porkers.

Of sheep, there were 21 entries, Wm. Cunningham & Sons showing the finest flock.

Of poultry, the display was good. C. L. Lee and Thos. Lazenby were the largest exhibitors. There were 50 coops.

There was $1250 paid on the livestock above enumerated.

In the vegetable and grain departments, the show was not large, only 75 entries. The presumption is that it was thought that the country being so full of superior articles in these classes, competition would be so strong that it would not pay to compete, and the early season of the Fair no doubt cut short this exhibit.

The show in flowers and fine arts was good.

The exhibit in farm implements and machinery was not up to the standard.

In the ladies’ departments, the show in fine needlework, etc., the entries were 265, and in the pastry department, including all delicacies, the entries were 200.

The total entries of the Fair were 1050, against 1200 last year.

The attendance of the people was good Thursday, estimated at 4000.

Friday eve, think there were 7000 people on the grounds, and, as far as we could judge, a very orderly and well behaved assemblage.

Nothing very startling occurred that came to our knowledge. One horse, running, flew the track, somersaulted over the fence with his rider; both got a hard fall, but were able to get up and try it again. The rider’s name was Frank Cook; not seriously hurt.

On man had his elbow dislocated by the kick of a colt when showing in the ring.

The society, financially, we understand, comes out all right—paying all premiums and expenses in full and also an indebtedness of $300, and will have a few hundred to begin business with another year.

The Secretary tells us that when all accounts have been settled and books audited an exact statement of receipts and expenditures for the year will be published.
