Dearborn County Circuit Court – Apr 1839

Dearborn County, Indiana, Circuit Court reports appeared in:

Dearborn Circuit Court.

This Court commenced its session on Monday last. There are a great number of Lawyers in attendance, and there seems to be much business before the Court. On Monday and Tuesday, there was something of a crowd on the Grand Jury—an unusual number of witnesses having been summoned to testify before it. We presume the Jury will not be discharged before Saturday.

Two State cases were tried on Tuesday. Palmer for larceny, and Cary for forgery. Both were acquitted.

We were in error last week in stating that the Court could sit four weeks—three only are allowed.

Three convicts made their escape from the jail in Wilmington, on Friday night last. We understand that the person who had charge of the jail, when carrying in wood late at night, was knocked down, and the prisoners escaped. One of them was arrested near North Bend, and brought back. The others are at large.

Dearborn Circuit Court.

The Court having laid over a great many cases for the next term, and dispatched a great deal of business on Monday, adjourned on Tuesday.

Six of the individuals indicted for riot at Rising Sun, were found guilty, and fined in sums varying from $10 up to $212. It may be proper to remark that three or four of the leaders, or principal actors in this case, have left the State.

The Jury in the case of Conaway against Harbert, were unable to agree. This case was tried at a previous Court, with a similar result. The parties have now compromised, and withdrawn the suit.
