The question of sanity being raised as to Fleming Cousins, the Court ordered he be enjoined from disposing of his property, both real and personal, except that he be permitted to dispose of crops, such as corn, wheat and hay. Case continued.

The Grand Jury only found one indictment—Fred Ogle, for murder—and adjourned Tuesday.

The Petit Jury was convened Tuesday, but did nothing and was dismissed until next Tuesday morning.

The case of Fred Ogle will come up next Tuesday.

Switzerland County Circuit Court – Jan 1893

COURT
Convened last Monday morning, Judge A. C. Downey presiding. Prosecuting Attorney R. L. Davis appeared to represent the interests of the State. He has appointed C. S. Tandy Deputy Prosecuting Attorney for this term of Court, his regular deputy, George S. Pleasants, being temporarily absent.

Monday the Court charged the Grand Jury, and appointed George W. Dorell foreman.

Yesterday the Grand Jury returned an indictment jointly charging with murder Marshal Travis, John Saunders, Albert Penn, Robert Schools (of Ghent, Ky.), Reuben Jones, Perry Andrew (of Vevay). They are charged with killing Oscar Leap, in Vevay, Saturday night, Nov. 5th. Yesterday afternoon the six defendants (all colored) were arraigned before Court, and plead “not guilty.” Their Attorneys asked for a change of venue from the county, which the Court granted, and sent the cases to Jefferson County, where they will come up in Circuit Court at Madison.

Owing to cold weather, the suspension of navigation of river, the absence of two Attorneys attending Legislature, in Indianapolis, several cases have been continued by agreement.

The Petit Jury has not yet been impanelled—because no case yet ready for them to try.

The case of Wesler vs. City of Lawrenceburg, brought here on change of venue, is set for today.

Capt. John B. Coles, of Rising Sun, is the only nonresident attorney who has been in Court—he on Tuesday.

It looks natural to see Lewis F. Works in Court. He was admitted to this Bar in 1868.

The Grand Jury visited the County Asylum, and in their report stated there was no “provisions for heating sleeping rooms, sick rooms, etc., provided by the county. We recommend that the County Commissioners give the heating matter their early attention.” They found the county jail secure and comfortable. The three cases pending against C. S. Tandy, as President of First National Bank of Vevay, growing out of refusal to answer questions asked him by Tax Board of Equalization in reference to the amounts deposited by individuals, came up, and the court quashed and dismissed the cases.

Sarah Humphrey vs. Frank H. McHenry; foreclosure of mortgage. Judgmetn for $100.75; and also to Robert A. Knox for $95.25 on cross complaint. Foreclosure ordered.

State vs. Eugene Tardy; provoke. Trial by court; not guilty.

Excused from serving as jurors for reasons satisfactory to the court: John W. Riley, David Hatch, Rodolph Poske. Vacancies were not permanently filled, but temporarily by Peter McMakin, Charles Noble, James Anderson.

State vs. Edward Martin; provoke. Verdict of jury not guilty.

The Louisville Trust Company vs. Jas. V. Anderson and others. Several cases [?] out of this suit. All cases were compromised, the judgment being taken by agreement, and foreclosure of mortgage. 1st, judgment in favor of Flora H. Schenck, $703; 2d, in favor of Eugene M. Eddy, Justine A. Zook, and Lillie C. Schenck, $840.73; 3d, in favor of Robert A. Knox, $1005.55; 4th, in favor of the Louisville Trust Company, $2,000—payable in annual payments of $500.

Louis N. Peelman vs. Belle C. Peelman; divorce. Granted, and he given possession of their child Ray Peelman.

The Grand Jury last Thursday, before adjourning, rendered a report to court, in which they stated they had been in session four days, examined sixty four witnesses, and returned nine indictments. In county jail they found two prisoners and in the county asylum twenty two inmates. The jail, from form of construction, is necessarily damp, and it would be well if better ventilation could be secured from near ground floor of jail building. The roof of county asylum is leaky and in bad condition; the outside stairway is weak and dilapidated; the opening to cellar way, in rear of house, has no covering, and it should be closed to avoid accidents that might occur.

State vs. Fred. Bender; two cases appealed from Justice of Peace. Verdict of jury in one case, guilty, and fined $5; in other case, tried by another jury, verdict of not guilty.

State vs. James Burk; petit larceny. Plea of guilty; sentenced to jail for ninety days and fined $1.

State vs. Newton Short; petit larceny. Plea of guilty; sentenced to county jail for sixty day and disfranchised for one year.

George S. Pleasants, administrator, vs. Mary Reeves; replevin. Verdict of court for defendant.

“Ordered by the court, that bail be required on indictments returned by the Grand Jury at the present term as follows: Assault and battery, with intent to commit murder, and the infamous crime against nature, $500; petit larceny, $250; giving intoxicating liquors to minors and carrying concealed weapons, $50.”

A decision of Appellate Court, rendered March 18, 1892, in the case of Andrew J. Courtney vs. America Courtney, appealed from Switzerland Circuit Court, was placed on record. It sustains the decision previously made in Switzerland Circuit Court.

Nellie Pate vs. Henry Pate, Jr., et al; alimony. Case dismissed.

Lillie McKenzie vs. John McKenzie; divorce. Court granted divorce in favor of plaintiff.

State ex rel Prosecuting Attorney vs. The Louisville, Cincinnati and Dayton railroad. Continued by agreement.

Antoinette J. Russell vs. Barney Klenburg; complaint. Effect given to decision of Supreme Court, that defendant (Klenburg) recover from the plaintiff (Russell) the costs in this case.

On claims presented by County Attorney and Clerk, the Court ordered that Ohio County pay $106, on account of Harriet Reister vs. Randolph School Township, brought here for trial in April, 1883. Also claims on cases brought here for trial—Jefferson county, $6714.10; Ripley county, $72. The jury, as published last week, was impaneled, except John H. Daubenheyer, who, at his request, was excused on account of his duties as County Assessor. The vacancy will not be filled until the jury is needed.

David S. Wilbur, of Rising Sun, special Judge in case of Philander S. Sage vs. James A. Works, on account, on Monday refused the application of plaintiff for a new trial—which leaves the case as formerly decided by him, in favor of defendant.

Nine cases of criminal charges were stricken from the docket, but indictments remain in full force.

State vs. John Jones; petit larceny. Plea of guilty; sentenced to penitentiary for one year and fined $1. The prisoner was unable to walk on account of pistol shot received from Sheriff while endeavoring to escape, and was brought into Court on a cot. Monday night he was taken to penitentiary at Jeffersonville, where, of course, he will be assigned to the hospital.

Anna B. Batchelor vs. John W. Powell. Change of venue by plaintiff from county and case sent to Ohio county.

Martha J. Smith vs. Elizabeth Mendenhall et al; to quiet title. Judgment for plaintiff.

Circuit Court

Opened Monday morning—Judge A. C. Downey on the bench, and Hon. R. L. Davis, Prosecuting Attorney.

M. G. Keeney, of Quercus Grove, and Wm. M. Patton, were excused from serving as Grand Jurors, on account of being sick. The Sheriff filled the vacancies with Peter McMakin and Gabe Robinson, both of Vevay.

Considerable probate business has already been disposed of.

Yesterday Ed Taylor, Archie Jones and Robert Gilbert were tried before the Court for burglarizing the shanty boat of John Robinson. This morning Judge Downey found them all guilty. He sentenced Ed Taylor to the penitentiary for two years, but in consideration of the youth and inexperience of Jones and Gilbert (both being minors) he gave them lighter punishment—sixty days each in the county jail.

In view of latest information in regard to L. C. & D., and there being good prospects for the building of the road, the case brought by Deputy Prosecuting Attorney against the company was again continued until next term.

The Grand Jury reported they had examined thirty three witnesses and found one indictment.

State vs. Ed. Taylor, Archie Jones and Robert Gilbert; burglary. Trial by Court; guilty. Taylor sent to the penitentiary for two years and disfranchised for two years. Jones and Gilbert being under 21 years of age, were sent to jail for sixty days each.

State vs. George Brown; malicious trespass. Trial by jury, fined $4 and sent to jail 120 days.

State vs. George Brown; assault and battery with intent to commit murder in second degree. Trial by jury; sent to penitentiary for two years and fined $1.

Charles E. Golay, of Vevay, was admitted a member of Switzerland County Bar.

John T. Ellis and James R. Cole were allowed $10 each for defending George Brown.

George B. Hall, of Ohio county, was admitted to practice in this Court.

State vs. Ed. McKay; disturbing meeting. Not guilty.

Estate of David Henry. David Dyer, Commissioner, reported sale of real estate at public sale to Edward G. Henry, Wm. H. Henry, Mary VanOsdol, and Drusella Henry, for $4,150. Sale and deed approved, and Commissioner discharged.

State vs. Carl Bray; disturbing public meeting. Not guilty.

Dennis G. Manning, of Vevay, was admitted a member of Switzerland County Bar.

David S. Wilber, of Ohio County Bar, was admitted to practice in this Court.

Kentucky National Bank, of Louisville, Ky., vs. James V. Anderson; on note. Judgment for $500.

Hon. A. C. Downey, the regular Judge, being related to one of the parties in the case of Philander S. Sage vs. James A. Works, on claim, appointed David S. Wilber a special Judge to try the case, which he did last Tuesday. The verdict of the jury was in favor of the defendant.

Several cases were settled by agreement and dismissed, and many cases on account of sickness and other causes, were continued.

Court adjourned Tuesday evening.

John F. McCreary vs. Francis M. Stevenson et al; partition. The deed by Samuel W. Wade, as Commissioner, for sale of lots 112 and 113 in Bela Herrick’s addition to town of Patriot, is ordered corrected—the name of Francis M. Tyrrell, as grantee of said sale instead of Francis M. Tarrell. This done by agreement of all parties.

“Ordered by the Court, that in all Guardianships pending in this county, where the guardian has not made and filed an inventory of the estate of the loan within three months after his appointment, if he shall have been so long appointed, (in accordance with the first division of section 2520 of the Revised Statute of 1881), showing the real and personal estate of his ward, with value thereof, and the value of the yearly rents of the real estate, the Clerk shall issue a citation to such Guardian, requiring him to make an file such inventory on or before the first day of the next term of Court, or then show cause why he has not done so, and should not be removed from his trust. No citation will be issued under this order when it appears from the papers on file that the ward or wards have no estate. Also that all guardians who have not reported for two years shall be cited to appear and report on or before the first day of next term.”

Edwin Mead, a petit juror of regular panel, fined $5 for contempt of Court—appearing in Court intoxicated.

George Marshall vs. Sylvia Marshall; divorce. Planitff, George Marshall, restrained from in any way encumbering and disposing of any portion of his property, and case continued until next term.

Louisa M. Slack vs. Ralph R. Stout; slander. Trial by jury; verdict of $1 and damages.

Rosa B. Aldred et al vs. William Miles et al; partition of real estate. Geo. W. McKay, Benjamin N. Davis and David Lee, Commissioners, reported division of lands, which was approved, and partition so ordered.

Lewis H. Dennis vs. Isaac N. Robbins et al; to correct deed and quiet title. Trial by Court; judgment for plaintiff; title to real estate quieted and finding that John Elfers held a lien by note and mortgage for $300.

Caroline J. Tandy vs. William Johnston, Sarah M. Johnston and John Riley; foreclosure of mortgage. Judgment against William Johnston for $250.45 and foreclosure of mortgage.
