Dearborn County Circuit Court – Oct 1839

Dearborn Circuit Court.

This Court convened at Wilmington, on Monday last. All the Judges were present, and the usual number of lawyers were in attendance.

The following gentlemen were empannelled as the Grand Jury, to wit:
Joel Decoursey, Esq., Foreman; Thomas Jones, Joseph Churchill, James Lyons, Vachel Hobbs, Jonathan Noble, John La Rew, Elisha Bodine, Thomas Cooper, Elias Little, David Conger, Amos Ross, David Cook, John Synder, and David Durham.

The court is disposing of business pretty rapidly, principally cases of petit misdemeanor.

On Tuesday, William Mason and John Wittermott, indicted for petit larceny—stealing a quilt, two bags and a vest from a Mr. Corson, below the mouth of Laughery—were tried, convicted, and sentenced to the Penitentiary for one year.

Dearborn Circuit Court.

This Court commenced its session on Monday last. There are a great number of Lawyers in attendance, and there seems to be much business before the Court. On Monday and Tuesday, there was something of a crowd on the Grand Jury—an unusual number of witnesses having been summoned to testify before it. We presume the Jury will not be discharged before Saturday.

Two State cases were tried on Tuesday. Palmer for larceny, and Cary for forgery. Both were acquitted.

We were in error last week in stating that the Court could sit four weeks—three only are allowed.

Three convicts made their escape from the jail in Wilmington, on Friday night last. We understand that the person who had charge of the jail, when carrying in wood late at night, was knocked down, and the prisoners escaped. One of them was arrested near North Bend, and brought back. The others are at large.

Dearborn Circuit Court.

The Court having laid over a great many cases for the next term, and dispatched a great deal of business on Monday, adjourned on Tuesday.

Six of the individuals indicted for riot at Rising Sun, were found guilty, and fined in sums varying from $10 up to $212. It may be proper to remark that three or four of the leaders, or principal actors in this case, have left the State.

The Jury in the case of Conaway against Harbert, were unable to agree. This case was tried at a previous Court, with a similar result. The parties have now compromised, and withdrawn the suit.

William H. Dow vs. Michael Gray et al; foreclosure; finding for defendant.

Minnie Potter et al vs. Albert W. Brown; for partition; J. D. Froman, F. M. Griffith and Geo. B. Hall appointed Commissioners and their report approved by the Court.

Tabitha Cayton vs. William Cayton; for divorce; granted.

Loring S. Dufour vs. Dora W. Dufour; divorce; granted and plaintiff given custody of Wilfred Dufour, conditioned on defendant having the privilege of visiting the child on proper occasions.

Three cases of indictment for profanity were dismissed.

The Madison Brewing Co. vs. Frank Coleman et al; on account; judgment for $126.70.

John L. Muret vs. Robert W. Scott; on contract; after trial commenced plaintiff dismissed case at his own cost.

William H. Dow vs. Martha Gray et al; for partition; settled by mutual agreement of parties and approved by court.

Tuesday Ella Sharp was granted a divorce from John W. Sharp. Pearl Dowers was granted a divorce from George Dowers.

Four young men were charged with disturbing a public meeting near Moorefield. One plead guilty and was fined $5, and the other three were dismissed.

The case of Ted Carver was set for Dec. 10.

The case of Charles Dibben, charged with assault and battery, on appeal from Justice of the Peace, was on trial yesterday afternoon, before the Court.

Court adjourned last night until next week.
