Special Session.

Joseph H. Burkam, Francis Lang and Warren Tebbs released from bond of F. M. Jackson, Trustee of Miller township. Jackson files new bond, with Thomas Langdale, Peter Braun and Francis Adkinson as sureties, in the sum of $8,000.

Abram Hill vs. Wm. H. Small; dismissed.

Thomas Gaff, surviving partner, &c., vs. the Auditor and Treasurer of Dearborn county; dismissed.

The latter is the famous Sunnyside case, in which the appellants submit to the inevitable decree of Fate, and become a part of the new fifth ward of the city of Aurora, with all the perquisites and appurtenances of such citizenship.

DEARBORN CIRCUIT COURT.
Special Session.

CRIMINAL PROCEEDINGS.

State of Indiana vs. Albert and Frank Manning—charge, grand larceny; verdict, three years in State’s prison, five dollars fine and five years disfranchisement each. The crime for which the above penalty was adjudged was the robbery of a Mrs. Winkley, living near Aurora, of about one hundred and thirty dollars in her absence, intimidating the only inmate of the house, their own sister, a mere child, by threats of death, and pointing a revolver at her to prevent her giving an alarm. They were captured in June last at Greensburgh, by Marshal J. R. Clemens.

State vs. Laborious Dill—plea of guilty; fined five dollars and costs for assault and battery. The assault was stabbing Jacob Johann, his nephew, with a knife, in June last. Laborious’ troubles all come from alcoholism, and the Court took a righteous view of his mental condition.

J. Halbert, charged with stealing a horse from H. Ickenroth; found guilty by a jury which returned a verdict of two years at Jeffersonville, five dollars fine, and disfranchisement for five years.

John S. Barrow, for knocking down and robbing J. H. Milholland three weeks ago, is under sentence by the Court on a plea of guilty. Judgement suspended; Barrow’s complicity appearing to be more of a drunken debauch and a maudlin assistant than that of a highwayman.

Otto Miller and Charles Winters were arraigned for a coat robbery at George’s Lane’s. Winters took all the crime upon his own shoulders, and was sentenced to Jeffersonville for one year. Miller was released—honorably discharged, as the Yankees have it.

COURT REPORT.

Court convened on Monday. Judge Roberts presiding.

State vs. John Kelley; desecration of the Sabbath; pleads guilty, and fined $3 and costs.

The grand jury was sworn in. John C. Younker and James D. Willis were appointed members of the grand jury, instead of Francis Swales and Frank R. Dorman. James D. Willis was appointed foreman.

In his charge to the grand jury the Court referred to a former report of that body respecting the jail. If this means on order for improvement, it is one step for humanity’s sake. As the jail is now, it is a disgrace to the county. There is neither light nor ventilation, and the sewerage pipes have been in place twenty years.

Patrick Keon, of Cincinnati, was sworn in as a member of the bar of this Circuit.

Henry Pieper and another have filed an information that one Mary E. Scholle, living in Ripley county, but having a personalty of $700 in this county, is of unsound mind, and should have a guardian.

The most of Tuesday and Wednesday was taken up in getting cases at issue.

Court opened with forty six new cases on the docket.

Hannah Marshall was appointed guardian of the minor heirs of Anson Marshall, deceased.

The Grand Jury returned six indictments on Tuesday, as follows: Alonzo Smith, two cases, charged with abducting his niece for the purposes of prostitution. The defendant being unable to employ counsel, the court appoints H. D. McMullen to defend him. He enters a plea of not guilty in both cases. In default of $500 is sent to jail.

State vs. Omer Pierce, Jack Moor and Wm. Bryant—assault and battery with intent to kill Charles Miller. All enter a plea of not guilty. Bryant and Moore being unable to employ counsel, H. D. McMullen was appointed to defend them. In default of $5,000 bail they were remanded to jail.

State vs. Jack Moore; petit larceny, charged with stealing a hat of George Philips. Pleads not guilty. Bail $200, in default taken to jail.

CIRCUIT COURT.

Final reports were made in the following estates and guardianships:

The Court ordered the arrest of all guardians and administrators who have failed to report their doings as per the order of the court.

Amy M. Dunn is declared a devisee, and entitled to receive a distributive share of the estate of Isaac Dunn.

Fred Wesler made a report as surviving partner of the late firm of Wesler & Bro. the report is approved as to the amounts with which he charges himself, and refuses to approve the report as to failure to sell real estate.

W. H. Bainbridge is allowed $32 for serving as Special Judge in the case of Cobb vs. McHenry.

Anton Schneider presents his resignation as commissioner in the case of Schneider vs. Koch, and Wm. Schneider is appointed in his stead.

Emma M. Rose vs. Hannah Marshall et al. Partition of real estate.

In the case of Lizzie M. Dove vs. Josiah Chambers’ estate, a demand for a struck jury was made.

The Grand Jury failed to return indictments against Irish Pat and Michael Kerrigan, owing to want of evidence, and they were discharged from custody.

The Petit Jury was sworn in on Monday.

The Grand Jury was discharged on Tuesday, after returning twenty indictments.

Wm. D. Horner, Adm’r of the estate of Jas. M. Boatman, dec’d, made his final report, and was discharged.

John Probst was appointed Guardian of the minor heirs of Joseph Sherbaugh, dec’d.

For want of evidence the Grand Jury refused to return indictments against John Emmitt and Wm. Smith, charged with stealing goods out of a car on the O. & M. R. R. at Cochran, and they were discharged from custody.

James Hall and Eddy West, indicted for petit larceny, and charged with breaking into and stealing goods from a car on the O. & M. R. R. at Cochran, were arraigned on Tuesday. A plea of not guilty was entered by them, and as they were unable to procure counsel, Wm. H. Bainbridge was appointed by the Court to defend them.

State vs. Lewis Garrison—malicious trespass. Trial by jury, and a verdict of not guilty.

John Locie, of Newtown, has been indicted for failure to return a correct list of taxable. He is charged with failing to list a promissory note of $800. Upon being arraigned he entered a plea of not guilty, and was bound over in the sum of $50, surety being furnished.

Joseph D. Curtis, guardian of Mrs. Sarah B. Nevitt, presents a petition from Mrs. Daniel Coy, who is a sister of Mrs. Nevitt, desiring to take care of said ward. The petition was granted, and Mrs. Nevitt was taken to Greensburg, the home of Mrs. Coy, who is to received $300 per annum for boarding, clothing, &c.

R. D. Brown was appointed guardian of the estate of Margaret Griswold.
