CIRCUIT COURT.

Final reports were made in the following estates and guardianships: Estates of Martin Koehler, Malinda Miller, Margaret Platt, Mason J. Cloud, John Dorst, Paulus Neurohr, Mary Anna Mondary, Carolien Pruden, and David Powers; Guardianships of Jacob Probst’s heirs, John S. Harper, Jacob Smith’s heirs, and Betty Epstein.

The will of Mary A. Luke, late of Dillsborough, was admitted to probate on Saturday. She bequeathed the bulk of her possessions to her son, Wm. F. Luke.

Will A. Greer, assignee of W. H. Murdoch, has transferred to Mr. Murdoch the property belonging to his estate—Mr. Murdoch having settled with his creditors satisfactorily by giving each creditor two notes, one payable in 12 months and one payable in 24 months.

Thomas L. Baker was appointed guardian of the minor heirs of Samiford Sparks. Bond $400.

John E. Baker has been appointed administrator of the estate of Wm. S. Bridwell. Bond $500.

Rebecca Walters has been appointed administratrix of the estate of John F. Walters. Bond $1,200.

Elizabeth Mangold was appointed guardian of the minor heirs of Jacob Mangold.

Wendel Labbe appointed administrator of the estate of Mathias Thebalt.

William Renner vs. Ann Clendenning. The plaintiff is granted possession of lots Nos. 16 and 17 in Lawrenceburgh, and judgment is rendered against defendant for costs.

Thomas Johnston, Foreman of the Grand Jury, made a report of their visit to the county jail, which reads as follows: “Having visited the county jail, we report everything in good order as to sanitary arrangements under the management of our excellent Sheriff. Mr. John Sims, and his excellent lady. The inmates seem to be well cared for, and we have no improvements to suggest at the present.”

Omar F. Roberts vs. Mary J. Roberts. Judgment against defendant for divorce. The plaintiff is required to pay William J. McHenry $2.50 per week for the support of Paul Wickliffe Roberts, who is placed in the custody of the mother.

John Cairns, commissioner in the ex parte proceedings of Jane Cairns and others, heirs of Claudius Anderson, makes a report of his doings in this case, which is approved by the court.

The Grand Jury adjourned on Saturday. During their session they found twelve indictments.

The will of the late Joseph Hall was admitted to probate. After the payment of debts, if any exist, all of the property, both real and personal, is given to his wife, Mrs. Ann Hall. The will bears date October 21, 1881.

Alice Goodwin vs. Jacob Goodwin. Judgment against defendant for divorce.

William Negele vs. Patrick Garrity. Judgment against defendant for $225.

Upon the petition of John Gaines, Administrator, the estate of Claudius and Jane Anderson are consolidated.

Andrew P. Daughters makes final report as commissioner of the estate of Britannia Heaton.

Hannah Marshal makes final report as guardian of the heirs of Anson Marshal and resigns her trust.

James Garrigus makes final report as administrator of the estate of Silas Wicks.

State on relation of Sarah Warner vs. Alfred M. Pate. Bastardy. Judgment against defendant for $600.

Hugh D. McMullen has brought suit against Ezra G. Hayes and Warren West, administrators of the estate of Joseph Hayes, for $3,500 attorney’s fees. The services were rendered in will contest.

M. H. Harding appointed administrator of the estate of W. W. Wymond, and gives bond for $16,000.

In the suit brought by John Kuhlmeier against his mother-in-law, Mrs. Wilhelmina Fensz, for board, &c., for two and a half years that she lived with him, Judge Givan decided for the defendant. He ruled that Mrs. Fensz was the guest of Kuhlmeier, and that therefore Kuhlmeier could not collect.

Kit Swales, blacksmith, and Henry Apparius, shoemaker, live neighbors in Bunkum. Some time ago Swales had his neighbor arrested for assault and battery, and Apparius had to pay about $12. Swales, encouraged by his success, sued Apparius for $1,000 damages. The jury returned a verdict for the defendant.

The suits of Francis Worley, administrator of Frank W. Cheek’s estate against the Travellers’ Insurance Company, of Hartford, Conn., has been compromised. Cheek, it will be remembered, was drowned while bathing, about six months ago. He was insured in the above company for $6,500, and they vigorously kicked against paying. In the compromise, Cheek’s estate receives $1,600.

Thus speaketh Roe: “A transcript is being prepared in the case of The City vs. Pius Fredrick on an appeal to the Supreme Court. The case grew out of an alleged infringement by the defendant in encroaching upon the line of Main Street, and it was litigated in the Circuit Court three years, and resulted in a verdict for the defendant. The costs, amounting to about $200, have been paid by the city. The defendant, Fredrick, having died in the meantime, the widow is made co-defendant, and the chivalrous corporation makes war on the defenseless widow. The transcript will probably cost about $300, and with good prospects of the taxpayers footing the bill.”

Colonel Jacob Eggleston and Hon. John S. Matthews are two of the most conspicuous citizens of Clay Township. They live in or near Dillsboro, and are neighbors. In a neighborly way they had alternately owned a bull, and the neighborly bull had alternated between the respective dairies of the two respected neighbors. Finally, Eggleston and Matthews got mad at each other, so to speak, and the charges and countercharges were made for the efficient services of the bull. Mathews put in a claim for superior calves, and Eggleston harped upon superior milk (not the bull’s), and in this way the neighborly neighbor’s jangled before Squire Hess till at last the case was appealed to the Circuit Court, where Judge Givan rendered a decision in favor of Mathews. The judgment amounts to $1.50.

Court adjourned until Jan. 31, 1881.

Mrs. Mary Marshall and Eliza Jane Beatty, of Chesterville, filed on Tuesday their notice of contest of the will of Nelson Ketcham, who died a short time ago. Mr. Ketcham, who died a short time ago. Mr. Ketcham just before his death executed the will which is to be contested. In this will he divides his estate equally between seven of his nine children, thus cutting the remaining two off without a shilling. The contestants set forth that he was of unsound mind, and that undue influence was used.

Zeph Heustis vs. George Tibbetts. Judgment against defendant for $413.

The following petit jury were impaneled: Charles Ashbey, Leroy Fleming, John A. Cole, Louis Ellerbrook, Thomas C. Jones, George Griffith, John Armstrong, Mark Johnson, Louis Weitzel, Robert Anderson, D. M. Brumblay, and Thomas Hargitt.

The defendants in the Joseph Hayes will case demanded a struck jury to try the case. The clerk gives notice that he will hold the striking on Saturday, the 8th inst.

Hettie S. Brewington vs. Johna Brewington. Divorce Granted, and the plaintiff is given the custody of the children.

P. L. Matheus vs. Elizabeth Mattocks. Judgment vs. defendant for $49.

Francis Adkinson vs. same. Judgment vs. defendant for $79.

The Judge ordered the committal of John Flanagan to the House of Refuge at Plainfield. Wm. Christopher conveyed the refractory lad to that reformatory institution on Saturday.

Louisa Gilliland was declared an heir to Sarah A. Thompson, deceased, and entitled to a distributive share in the monies belonging to that estate. The clerk was ordered to pay her $133.

A voluminous transcript from Ohio county in the case of William H. Burges vs. Lucinda Powell and others, for damages, has been filed in the Clerk’s office. The case comes to this court on change of venue.

The case of the guardian of George Ludlow against the guardian of Brower Ludlow, which was appealed to the Supreme Court, has been dismissed.

W. H. Dowdell, admr., &c., vs. Jane Sheldon, et als., continued until the next term.

George Beckenholdt vs. J. C. McCullough, Receiver, &c. The defendant is ordered to pay taxes on personal property to the amount of $195. The Court also finds that taxes to the amount of $272 on real estate shall accrue against the same.

In the great case of Joanna Nevitt vs. the administrators of the estate of David Nevitt, deceased, the jury, after being out nearly all night, brought in a verdict for the plaintiff, giving her $300. The plaintiff is the widow of Wm. Nevitt, who was a son of David Nevitt. Some time after the death of her husband she went to live with her father-in-law as his housekeeper, taking with her three children, each of whom was old enough to earn a living. The plaintiff remained there for about five years, and filed her claim for $1,500 for services. The claim was stoutly resisted upon the ground that plaintiff had been fully compensated, and that she lived with the defendant as a member of the family, without contract, expressed or implied, for compensation.

An interesting suit was begun before Judge Givan on Monday morning, in which Judge Tullis, nephew of the noted Jerry Tullis, and Louis, Wm. H. and Lena Teake, all children by former husbands of the late old mother Veit, of Dillsboro, are the plaintiffs, and Louis Veit, husband of the late mother Veit, is the defendant. It appears that when Mrs. Veit purchased a lot of property in and about Dillsboro, valued at about $12,000, she had it deeded to her and her husband jointly. The plaintiffs allege that this property was purchased with the money obtained by selling an estate which their father left them, and that now because the property in question was jointly deeded contrary to the wishes of their mother they are now to be swindled out of their patrimony. The John Tufts who makes a claim in the case is the same who claims $10,000 worth of the Jerry Tullis estate, and who for the same is making a fight.
