Switzerland County Commissioners – Dec 1872

Proceedings of County Commissioners.

Among other business transacted by the County Commissioners, was the following:

Madison Mayfield was appointed a Constable.

In the matter of C. W. Bruner and others, for location of highway in Cotton Township, Silas Potter, Samuel B. Hyde and Ovid Potter, were appointed viewers, who will report at the next session of the Commissioners.

William G. Campbell, Thomas Delaney, John J. Roberts and John G. Cotton, of Vevay; and Joshua Scranton, of Patriot, were granted Licenses to retail liquors.

In the matter of the Petition of John Higham and others, for location of road in Posey Township, Wade H. Jack, Henry Dibble and Charles Dibble were appointed viewers, to report at the March Term.

In the matter of the Petition of P. Rumrill and others, for location of highway in Craig Township. Viewers reported and road granted.

County Bonds were ordered to be issued to the amount of $2,500.00.

Since our last Report the following cases have been disposed of:

Henry A. Downey vs. Wm. T. Daily and others—on account. Tried before the Court. Judgment for the plaintiff against some of the defendants for $50.

Eleazor B. Anderson and others vs. Jackson Sheets and others—for money. Judgment for plaintiffs by agreement for $200.00.

Wm. Parker vs. Wm. T. Wiley—malicious prosecution. Trial by Jury, and verdict rendered for the defendant.

Wm. S. McKay vs. Oliver Cain—appeal from Justice of the Peace.—Tried by Jury, and verdict rendered for the plaintiff for $20.

Caroline Daubenhyer vs. Ferdinand Luke—appeal from Justice of the Peace, on account. Trial by Jury, and verdict rendered for the plaintiff for $33.76.

Aaron B. Howe vs. Abner M. Thornton—appeal from Justice of the Peace, on account. Trial by Jury, and verdict for the plaintiff for $15.55.

Green Durbin vs. Wm. Craig—on account. Change of venue to Jennings County.

First National Bank of Vevay vs. George M. Oakley—to recover real estate and money. Change of venue from the Judge. To be tried by Judge Carter on the 17th day of December, 1872.

Circuit Court—Judge Berkshire.

Switzerland County Circuit Court commenced its regular Fall Term last Monday—Judge Berkshire presiding. Maj. Oscar Cravens, the newly elected Prosecuting Attorney, has been entered upon the duties of his office. By the way, several Attorneys, who are competent to judge, inform us that he is the best qualified Prosecuting Attorney we ever had in this Court. Even an “outsider,” who is not acquainted with the legal profession, can see that he is prompt, energetic, and is anxious to do his business correctly.

In addition to our resident Attorneys, we notice the following from other places: C. A. Korbly, and Judge Walker, of Madison; Hon. S. H. Stewart and Reed Downey, of Rising Sun.

Switzerland County Common Pleas Court – Sep 1872

Court Proceedings.

September Common Pleas Court is in session. Hon. Scott Carter Judge presiding. Present the members of the Bar of Vevay and Hon. C. A. Korbly of Madison, Hon. S. H. Stewart of Rising Sun.

The Docket is but a small one and has but a few important cases pending. The case of George F. Tardy et al vs. Will M. Smith, Executor of the last will and testament of George Tardy, deceased, et al, to set aside a will, is the most important one pending in the Court, but will not probably be tried this term. There has been a change of Judge taken in one case, while fifteen have been dismissed. The following other cases have been disposed of as indicated:

State vs. Daniel Plew, 2 cases, selling liquor on Sunday. Acquitted.

State vs. Daniel Plew, Assault and Batery. Fined $1.

State vs. Columbus Stepleton, Assault and Battery, 2 cases. Acquitted.

State vs. Isaac Truman, carrying concealed weapons. Acquitted.

Annie Liddell vs. John Liddell. Divorce. Granted.

Jeremiah Bennet vs. John W. Miller et al. Foreclosure. Judgment for Plaintiff.

Special Term of Circuit Court—Judge Emmerson.

A special Term of the Circuit Court convened in this place last Monday. The following cases have been disposed of:

The most important case in this Court—that of Columbus D. Conway vs. Samuel E. Pleasants, Administrator of Ira Lindley, deceased—was postponed until Sept. 10th, on account of the illness of one of Judge Walker’s family; Walker is one of the Attorneys of Conway.

Special Term of Circuit Court—Judge Emmerson.

Since our last report the following cases have been disposed of:

Wm. G. Krutz vs. Michael Platz—an appeal from Justice of Peace, on account. Judgment for defendant.

J. W. Thompson vs. Martha P. Thompson—Divorce. Granted.

Five cases were continued until the 10th of September.

Court adjourned last Friday.

Switzerland County Commissioners – Jun 1872

The Switzerland County, Indiana, Commissioners’ proceedings appeared in:

Proceedings of County Commissioners.

The County Commissioners adjourned last Saturday. Among other business transacted at this Term was the following:

In the matter of James T. Bodkin and others—For change of Highway, in Posey Township. Joel D. Davis, John N. Searcy and Stephen Searcy, were appointed Viewers. To meet on the first of August, 1872.

In the matter of Philip Rumrill and others—For change of Highway, in Craig Township. Constant Golay, H. C. Picket and William R. Protsman, were appointed Viewers. To meet on the 17th of August, 1872.

The Grand Jury visited the County Jail and made the following report as to its condition:–
It is sufficient and safe for the keeping of prisoners; but we do not find the prison in a healthy condition, from the fact that there is not proper and sufficient ventilation; and that the prison is so constructed that prisoners of both sexes are necessarily thrown together, and cannot be kept separated; and that, further, owing to the manner in which the prison is situated in the building the air in the prison is vitiated by it. We have enquired into the matter in which the same has been kept since the last term of the Court, and find that it has been kept in a good, safe and healthy a condition as it could be under the circumstances. We would further state that one of the prisoners complained that there was not sufficient beds furnished to prisoners.—David Lee, Foreman.

In the matter of petition of J. F. Cotton and others for vacation of Highway. Ordered that said road be vacated in accordance with the petition, and report of viewers when the new road is opened.

The Board appointed physicians to attend on paupers and poor persons in the County, as follows:

  • For Jefferson and Craig Townships and the Pauper Asylum—Dr. Jacob W. Thompson, a salary of $150.00 per year.
  • For York Township.—Dr. Benjamin H. Graves, at salary of $50 per year.
  • For Quercus Grove, Voting Precinct, Posey Township.—Dr. Edgar M. Cheever, at salary of $25 per year.
  • For Patriot Precinct, Posey Township.—Dr. R. A. Jameson, at salary of $45 per year.
  • For Cotton Township.—Dr. James Hunter, at salary of $40 per year.
  • For Pleasant Township.—Dr. Philip C. Holland, at salary of $40 per year.

The Board no proceeded to levy the tax for County Revenue, and to maintain paupers and poor persons for the year 1872, to-wit: On each one hundred dollars valuation of real and personal property legally appraised and assessed in said County for the year 1872, the sum of sixty cents, and fifty cents on each poll for county revenue; and on each one hundred dollars as appraised and assessed as aforesaid, the sum of ten cents, as a pauper tax for the maintenance of paupers and poor persons in said County.

The amount of County Orders allowed by the Board during the term for various purposes was $3,000.64.

It was decided not to place the Railroad Tax on the Duplicate.

Samuel Stewart was appointed inspector of elections for Quercus Grove Precinct, in Posey Township.

Circuit Court adjourned on the 21st inst.

The last case tried was that of Mrs. Graham vs. Geo. A Hotchkiss. This was a suit brought for about one fourth of an acre of land in Pleasant Township. The Judge has not yet rendered a verdict.

A Special Term of the Common Pleas Court was to have been held last Tuesday; but for some reason Judge Berkshire postponed it until July 30th next.

Proceedings of the County Commissioners.

The County Commissioners closed their March session last Saturday night. Among other business transacted was the following:

In the matter of the petition of George W. Woodruff and others for vacation of highway. The viewers, S. B. Hyde, Silas R. Potter, J. J. McIntosh, reported  in favor of vacating said road.

In the matter of the petition of Wm. S. Twinham and others for vacation of highway. Thomas B. Dow, Jonathan McMakin, Solomon Waldon, viewers, reported that in their opinion said road was not of public utility. Benj. F. Rodgers, filed his objections to said report. The Commissioners sustained the objections of Rodgers, and laid aside the report of the viewers.

In the matter of the petition of John F. Cotton and others, for vacation of highway. John R. Morerod, Francis R. Dufour and Robert A. Knox were appointed viewers, to report at the next session, in June.

In the matter of the petition of Robert Scott and others, for location of highway. Dismissed.

The following persons were selected by lot by the Commissioners to act as Grand Jurors, for the May term of the Circuit Court:

John Vanhouten, was licensed to retail liquor in Patriot. Volney Peelman was also licensed to retail liquor in Florence.
