LAW REPORT.
Switzerland Circuit Court.

Court convened last Monday morning.

The following attorneys from a distance are in attendance: Prosecuting Attorney M. R. Sulzer, Hon. J. Y. Allison, Madison; Wm. Walker, Esq., Patriot; and Capt. J. B. Coles, Rising Sun.

W. P. Lock, who was drawn as a Grand Juror, being sick was not able to appear. Wm. S. Tower was selected to fill the vacancy, and is Foreman. The Judge instructed the Grand Jury Monday morning and it is now in session.

 

The following are among the cases disposed of:

State vs. James Brown. Public indecency. Dismissed.

State vs. Gabe Gerard. Selling liquor. Plea of guilty. Fined $10.

State vs. Merit Roberts. Selling liquor on Sunday. Plea of guilty. Fined $10.

State vs. Gabe Gerard. Selling liquor Thanksgiving Day. Plea of guilty. Fined $10.

State vs. Merit Roberts. Selling liquor on Thanksgiving Day. Dismissed.

State vs. Gabe Gerard and Merit Roberts. Selling on Sunday. Dismissed.

State vs. Joseph Thamann. Selling liquor on Sunday. Plea of guilty in two cases. Fined $10 each case.

State vs. Joseph Thamann, Sr. Selling on Sunday. Dismissed.

State vs. Wm. Rowin. Selling liquor on Sunday. Tried by Court, found guilty and fined $10. One case dismissed.

State vs. Francis Eads. Carrying concealed weapons. Plea of guilty. Fined $1.

State vs. James and Tude Brown. Disturbing meeting. James plead guilty and was fined $5. The case against Tude was dismissed.

State vs. Frank Turner. Drawing dangerous weapon. Plea of guilty. Fined $1.

State vs. William Turner. Assault and battery. Dismissed.

 

Several cases have been continued by the mutual agreement of parties.

The Petit Jury is summoned for next Monday.

Judge Friedly has fixed the times for trying cases as follows:

State vs. Taylor Brownfield; assault and battery. Trial by Court, fined $10.

 

Costs are added to amounts of Judgment.

Business is being disposed of rapidly.

Joseph A. Hart and John F. Patton are assisting Clerk Abbott, and all are kept busy.

Delinquent Administrators, Executors, and Guardians, were gently stirred up last term, and many at once reported. At this term Judge Friedly firmly, but respectfully, quotes the rugged law to those who are tardy with trust funds, and they are rendering reports.

The Grand Jury returned twenty-seven indictments and adjourned.

Three vacancies were created on the Petit Jury drawn, for the following reasons: Samuel Jackson, not found; Peter R. Lostutter and Daniel Brindley, not free holders and house holders. William Twineham, Ostrum Boright and Enoch W. Protsman, were selected to fill the vacancies.

Hon. Stephen H. Stewart and Capt. J. B. Coles, of Rising Sun, are attending Court.

The case of Schenck vs. McMakin will come up today.

Andrew J. Schenck et al vs. Jonathan McMakin; to recover real estate. Verdict of Jury for possession of real estate and $1 damages.

Julia Froman and Mary E. Atwood vs. Mary Walden; slander. Dismissed. Also same vs. James B. Walden; slander—dismissed.

State, ex rel County Auditor, vs. Matilda Lee et al; foreclosure school fund mortgage. Trial by Court—judgment for $741.15.

Maley Spencer vs. George J. Thiebaud; slander. Tried by Jury, verdict for defendant.

Eliza Brown et al vs. John John Brown; partition. Granted and Peter McMakin appointed Commissioner to sell land.

 

STATE CASE.

State vs. Irvin Peters, James Peters and Smith Armstrong; assault and battery with intent to murder (Charles Wiseman). Irvin Peters tried by Jury—found guilty of assault and battery, fined $100.00 and costs. The cases against James Peters and Smith Armstrong were dismissed.
