LAW REPORT.

A Special Term of the Circuit Court was opened by the Hon. Jas. Y. Allison, last Tuesday morning. John B. Coles, Maj. J. S. Jelley, and Maj. John O. Cravens were the only Attorneys in attendance from abroad.

The following business has been disposed of:

State of Indiana vs. James H. Davies—selling to minor. Default and forfeiture of recognizance.

Same vs. Charles Golay—selling to minor. Nol. Pros.

Same vs. Henry Schewe—selling without permit, three cases. Defendant pleaded guilty, and was fined $10 in each.

Same vs. same—selling without permit, three cases. Submitted to the Court and was fined $10 in each.

Same vs. same—for same offense two cases. Submitted to the Court and acquitted.

Same vs. William Banks—illegal vending, two cases. Defendant pleaded guilty, and was fined $10 in each.

Same vs. William Cassell, William Deaver, Frank Blair, Emma Blair, and Sarah Russell—grand larceny. Cassell, Deaver and Blair pleaded guilty, and were sentenced to the State’s Prison for two years, fined $1 each, and disfranchised for five years. A Nolle was entered as to the others.

Same vs. George Gleason—assault and battery. Defendant pleaded guilty, and was fined $1.

LAW REPORT.

Special Session of Circuit Court—Judge J. Y. Allison.

Since last report, the following cases have been disposed of:

State of Indiana vs. Edward Manuel, jr.—Assault and battery. Defendant pleaded guilty, and was fined $10.

Same vs. Henry Schewe—illegal vending, one case. Indictment quashed.

Same vs. Charles Schmeid—Assault and battery with intent to murder.—Tried by a jury who returned a verdict of guilty of assault and battery, and assessed a fine of $50 against the defendant.

The Pleasant Grove and Indian Creek Turnpike Company vs. R. D. Gullion—On subscription. Submitted to jury, who failed to agree.

The case of William J. Keeney vs. Charles Schmeid, for damages, was called up Tuesday Evening. It will probably consume the balance of the present term.

LAW REPORT

The regular March Term of the Circuit Court convened upon Tuesday, the 23d inst., Hon. John G. Berkshire, presiding.

The following is a list of Attorneys in attendance from abroad:
Hon. H. W. Harrington, Indianapolis; Maj. J. S. Jelley, S. H. Stewart and J. B. Coles, Rising Sun; Capt. S. M. Jones, E. P. Ferris, Adam Stockinger and John O. Cravens, Prosecuting Attorney, Versailles; John K. Thompson, Lawrenceburg; Hon. C. E. Walker and Capt. A. D. Vanosdol, of Madison.

Hon. James Y. Allison, of Madison, having come up to try several causes in which a change of Judge had been granted. Judge Berkshire, after disposing of a few cases, surrendered the court room to Judge Allison, and opened Court Wednesday morning in the Clerk’s Office.

The case of the State ex rel the Board of County Commissioners of Ripley county, and also ex rel Phillip Seelinger, Auditor of Ripley county, vs. Henry Yater et als, on official bond, a case sent from Ripley county, was called by Judge Allison, a jury empaneled, and the case began.

Switzerland County Commissioners – Mar 1875

The Switzerland County, Indiana, Commissioners’ proceedings appeared in:

Commissioner’s Court.

The County Commissioners convened in regular session last Monday. Among other business transacted was the following:

The Township Trustees made their Annual reports of receipts and disbursements of receipts and disbursements of money for the year ending March 1.

In the matter of Jonathan McMakin and others to have road described and entered of record. On motion of Huldey Sullivan, the petition was dismissed for want of form.

In the matter of petition of Robert Bovard and others for change of road.—Viewers reported favorable, and road located, 33 feet wide.

John A. Lineback was appointed Turnpike Assessor, vice Thos. Armstrong, resigned.

The County Treasurer reported having redeemed Orders amounting to $33,328.69, for the Quarter ending March 1st:

Township Assessors were appointed as follows:

Commissioners Court.

The County Commissioners adjourned last Tuesday. Among other business transacted that day was the following:

The A., C. S. & V. Turnpike Co. was granted permission to assess omitted lands. Assessors—Wm. Anderson, Wm. Dalgleish, and John W. Howard. To meet March 22d.

In the matter of petition of Wm. J. Keeney and others, for change of highway. Thomas Armstrong, David Lee, and R. E. Hall, were appointed viewers. To meet March 17th.

In the matter of Lewis Schroeder and others, for location of highway. John W. Morison, Henry Myers and Wm. Clevenger, were appointed viewers. To meet April 12th.

John Gill was appointed to superintend the work on Shull’s Hill.

Switzerland County Commissioners – Feb 1875

Special Session of the County Commissioners.

The County Commissioners held a special session Jan. 29th.

Being the lowest bidder, Wm. B. Sink, of Rising Sun, was given the contract to grade Shull’s Hill. Price $8.50 per rod, lineal measurement. To be completed by the first of August next.

Wm. Anderson, of Craig Township, was appointed Assessor of Benefits for Turnpikes in the 1st District.

The Directors of Allensville, Center Square and Vevay Turnpike Co. were granted permission to assess benefits on omitted lands. Thomas Armstrong, Wm. Anderston, and Wm. Dalgleish were appointed to perform that duty.

Joseph Peelman was employed to do some work on the jail.

Switzerland County Commissioners – Dec 1874

The Switzerland County Commissioners’ proceedings appeared in:

The County Commissioners
Met last Monday. Among other matters that came before them was the following:

The last Grand Jury reported that repairs were needed in the county jail, of which the Commissioners took due notice and have taken steps to carry out the recommendation of the jury.

Jacob S. Shaddy, the Assessor elect, filed his Bond, which was approved, and took his official oath.

James Tate and John S. Gurley were appointed Constables for Posey Township.

James Vaughn was appointed a Constable for York Township.

David Melick was appointed a Constable for Cotton Township.

Geo. H. Redd was appointed a Constable for Jefferson Township.

Nearly all of the Constables were appointed on account of the Constables elected in Oct., 1874, failing to qualify.

In the matter of the petition of James Rayl and others. Viewers reported favorable, and highway ordered to be vacated.

Petition was presented by Robt. Bovard, Wm. Sanders and others, for change of highway. Edward Abbott, John Stewart, and Royal Aldrich were appointed viewers.

Case of W. J. Keeney and others for highway in York Township, was before the Board and points of law argued by Mr. Livings for petitioners, and J. A. Works & Son for Charles Smead.—The report of Viewers was received and re-Veiwers were appointed to assess damages.

A Grand Jury for March and October terms, 1875, of the Circuit Court were drawn.

The question of grading Shull’s Hill was discussed, and it was decided to do so if it can be done at a satisfactory price. The Commissioners invite proposals for doing the work.

The Switzerland County, Indiana Circuit Court Traverse Jury appeared in:

The following gentlemen will compose the Traverse Jury at the next January Term of the Switzerland Circuit Court:

  • Jefferson Township—Achilles Ogle and Marion Reeves
  • York—Harry Krutz and James Vaughn
  • Posey—Lewis P. Bradford and William Platt
  • Cotton—Shelometh Stow and George McCullock
  • Pleasant—Alexander McCullock and James W. Christie
  • Craig—James Shaw and Joseph M. Clements

Court will commence the first Monday in January.
