SPECIAL TERM—JUDGE ALLISON.

A special term of Court was commenced last Tuesday.

The case of Ripley county vs. the Auditor of Switzerland county to compel him to issue order for money claimed. Finding for plaintiff to the amount of $1,180.86.

The issues are being made up in the case of Charles A. Clarkson et al vs. Eliza M. Dufour, sen., et al, but as Judge Allison has to commence a term of his own Circuit next week, he will not have time to try the case now. He will return as soon as possible and hear the case.

Commissioners’ Court.

The Board drew a Grand Jury for the March Term, 1878, as follows:

  • Theodore Pickett, John H. Brown, 1st District.
  • Wade H. Jack, Abner Gates, 2d District.
  • Henry Tinker, Leonard Griswold, 3d District.

For the October Term, 1878:

A. B. Vanatter, Trustee of Cotton Township, presented his report for the year ending March 1, 1878. [see newspaper for report.]

Elwood Mead was appointed as one of the two scholars or students to which this county is entitled, to Purdue University.

The following places of voting were fixed by the Board. [See newpaper.]

The Trustees were ordered to make reports to the Board on the second Monday in April next.

It was ordered by the Board, that hereafter County Orders or Warrants be cancelled by writing the word “cancelled” across the back of the same, that they be put up in bundles and properly labeled, and that the Treasurer require each payee to write his or her name across the back of the order or warrant, so as to show to whom the money was paid.

George W. McKay, John H. Brown and Joseph Cowan, were appointed as viewers, in the matter of the petition of Perry K. Cotton and others for a change, vacation and location of a highway near J. G. Coleman’s, in Craig Township, to report a the June Term.

C. J. Robenstein, Treasurer, presented to the Board the county orders redeemed by him since the last meeting of the Board, which were examined with the Treasurer’s Register and Auditor’s books, and cancelled, amounting to $10,399.55.

Jacob Banta was appointed Superintendent of the two bridges across Indian Creek, and the bridges across Hunt’s and Plum Creeks, and authorized to have the same repaired when needed.

Philander Morrison the same for Log Lick bridge, with same authority.

William Stewart for the bridges in York and Posey Townships, with same authority.

Jacob Banta was appointed Superintendent of the Poor House and Farm.

The matters in controversy between this and Ripley county were adjusted and settled, the amount being $1,202.36.

The bridge across Goose Creek was ordered to be closed up as unsafe.

An Adjourned Term of the Circuit Court was commenced on Tuesday, Dec. 26th, the Hon. John D. Haynes, of Dearborn County, presiding. The following is the disposition of cases:

The State, ex rel Mary Butles, Guardian, &c., vs. John F. Doan, Jr., on a retailer’s bond. Dismissed by plaintiff.

Charles A. Clarkson vs. Eliza M. Dufour, et als. To quiet title. Dismissed by plaintiff. Suit was immediately recommenced.

State vs. Perret Dufour. Indictment for forgery. Indictment quashed.

A regular Term of the Circuit Court will be commenced next Monday. Judge Berkshire will preside.

Switzerland County Commissioners – Dec 1877

Commissioners Court.

The County Commissioners met last Monday, and will probably remain in session during the remainder of the week. The following is a condensed report of their proceedings from day to day:

MONDAY.

John H. McHenry and Henry Likely, the viewers appointed on the petition of Alfred Downey and others for the vacation of a highway in Cotton Township, reported the same not of public utility, and the same was ordered vacated. On petition of said Alfred Downey and others a new road was established in said township as prayed for in their petition.

 

TUESDAY.

Charles J. Robenstein, Treasurer, presented to the Board for cancellation the county orders redeemed by him during the last quarter, with his account for registration of same, amounting to $18,413.18; which orders were examined, compared with the Auditor’s books, and destroyed by burning in the presence of the Board.

 

WEDNESDAY.

Samuel Adkinson was appointed a Justice of the Peace for Craig Township, to fill a vacancy occasioned by the removal from this State of John Lancaster.

LAW REPORT.

At the October Term, Judge Berkshire appointed Theodore Livings to hold an adjourned term of Court, to commence last Monday. In accordance with this appointment Mr. Livings convened Court last Monday. At the call of the first case on the docket the question was raised as to the jurisdiction of the Court. The question was ably discussed pro and con, and after due deliberation and searching authorities, the Court decided it had jurisdiction, and Court proceeded.

Joseph W. Tague vs. F. S. Koehler. Dismissed on account of death of plaintiff.

The last case tried at the adjourned term of Court, Theo. Livings pro tem Judge, was that of John S. Malcomson vs. Rude D. Gordon, for foreclosure of mortgage, in which a judgment and decree was rendered for $273. Of the eleven cases on the docket, two were dismissed, one tried, six continued, and the remaining two going over to the regular term in January next.
