Switzerland County Commissioners – Mar 1891

Switzerland County, Indiana, Commissioners’ proceedings appeared in:

COUNTY BUSINESS.

County Commissioners Orson A. Potter, Wm. O. Marble and C. D. Green, met Monday, March 2, and adjourned last Friday, 6th.

The Township Trustees presented their reports, which were all approved.

John S. Rice, of Patriot, was exempted from poll tax, on account of being a cripple.

John Joyce, Fletcher Bellamy and Robert W. Scott, viewers appointed at December term, to examine as to vacation and relocation of highway through lands of John Clements, Joshua Coleman, and others, in Craig Township, reported that Feb. 2 they viewed said road, and reported proposed vacation and relocation of road was not of publication utility. Report approved.

John W. VanOsdol, Trustee of Cotton Township, was granted permission to borrow $200 for use of his township. Mr. VanOsdol paid into County Treasury $82.78 surplus dog tax.

The Commissioners adapted the following order of business: First day—Trustee Reports, in the following order: Posey, Cotton and York Townships. Second day—Pleasant, Craig and Jefferson Townships, and liquor licenses. Third day—Road petitions, report of superintendent of Poor Farm, and cancelling of County orders. Fourth day—Reports of County officers, miscellaneous bills, and general business.

Charles McVey, Trustee of Jefferson Township, was granted permission to borrow $800 for use of the Township.

Joseph G. Thaman, Vevay, and Dorwin Marshall, Florence, were granted license to retail liquors.

Enoch S. Adams, Supt of County Asylum and Poor Farm, presented his quarterly report, showing 45 inmates full time and 5 inmates part of time, making a total of 50.

George W. McKay, Wm. M. Brindley, and Wm. Anderson, appointed last December to view opposed highway, running through lands of Rosaline and Eli Anderson, and others in Craig Township—reported that Feb. 2 they examined route for said proposed road and find the road would not be of public utility. Continued until next term.

The above viewers also reported unfavorably upon proposed road through lands near McKay Graveyard, in Craig Township. Continued until next term.

Wm. M. Patton, appointed inspector to examine the old abutments of Bry Creek bridge, and also the old iron bridge now stored with Charles Markland, at Markland, with reference to placing said bridge on said abutments—presented a report stating that said abutments are in bad condition and not suitable upon which to erect said bridge; said abutments are too far apart and would have to be rebuilt, to conform to the span of said bridge which is not more than 75 feet. The report was approved, and petition to place said iron bridge on abutments on Bryant’s Creek not granted.

Wm. Tait, County Treasurer, presented orders amounting to $16,130.65 redeemed by him for quarter ending Feb. 28th. Found correct. He also presented warrants for Congressional School Funds, $1,282.48 and warrants for Common School Funds, $8,639.96, redeemed by him for quarter ending Feb. 28. Found correct.

Walter C. Benedict, Clerk elect of Switzerland Circuit Court, filed his bond of $10,000—Charles Markland and Ebenezer Phillips, securities. Bond approved.

It was ordered by the Board what hereafter Trustees in making allowances for paupers in their several Townships, shall itemize the articles provided, to consist of the actual necessaries of life, plain food and clothing, and in quantities not exceeding $8 for one person for one quarter.

William Hall, Executor of the estate of Joshua Smithson, deceased, and administrator of the estate of Sarah Smithson, deceased, vs. Eugene W. Smithson, deceased, vs. Eugene W. Smithson et al; to construe two wills, &c. Mr. Hall as Commissioner reported sale of a portion of real estate, and resigned as such Commissioner. Geo. S. Pleasants appointed Commissioner to sell remainder of real estate.

Robert B. Henry vs. James M. Scott, Trustee; to have an accounting. Tried before Chas. E. Walker, special Judge. Judgment for defendant.

Elvira Murret et al vs. David Huston et al; partition of real estate. Commissioner reported sale and deed was approved.

State vs. Tobe Still; assault and battery. Plea guilty, fined $1.

State vs. Samuel Gilbert; assault and battery. Tried by Court, not guilty.

David Brownfield vs. John W. Neal; to quiet title. Dismissed by plaintiff at his cost.

State ex rel D. N. Haydon, Auditor, vs. John L. Smith et al; foreclosure—Dismissed by plaintiff, costs paid by defendant.

Cynthania K. Scranton vs. Jason G. Gurley; on note. Judgment for $200 by agreement.

State ex rel D. N. Haydon, Auditor, vs. Stephen Ricketts et al; foreclosure. Judgment for $834.84 and 2 percent damages and foreclosure.

State vs. Stephen Spears; selling intoxicating liquors without license, five cases. Plea of guilty in two, fined $5 and costs each case, three cases nollied.

State vs. Samuel Fallis, assault and battery with intent. Jury fined him guilty of assault and battery, fined him $100 and imprisonment in county jail for four months.

The Grand Jury returned 25 indictments.

State vs. Silas Silvers—selling liquor without license. Plea of guilty, one case, fined $5 and costs.

State vs. John Schaffer—larceny.—Found guilty and, being a minor, committed to the Indiana Reform School for Boys until 21, or legally discharged.

Frederick W. Housemeier vs. Isaac Richards—to revive judgment. Finding for plaintiff.

David Lostutter vs. William D. Wallick—on note. Dismissed at cost of defendant.

State vs. Thomas Heady—assault and battery. Plea of guilty, fined $1 and costs.

State vs. Irven Montayne—assault and battery with intent, etc. Trial by Jury. Found guilty of assault and battery; fined $5 without costs.

COUNTY BUSINESS.

The County Commissioners met Monday, 1st, and adjourned last Friday, 5th.

Cornelius D. Green entered upon his duties as Commissioner from the second district, vice William H. Scott, term expired. The other Commissioners are William O. Marble and Orson A. Potter.

James A. Lovell, Marion Joyce, John M. Clements, and others, petitioned for vacation of road in Craig Township. John Joyce, Fletcher Bellamy, and Robert Scott, appointed viewers—to report at March term.

James V. Anderson, Thomas J. Wiseman, W. S. McKay, and others, petitioned for change of Tucker’s Run road in Craig Township. William W. Brindley, William Anderson, and George W. McKay, were appointed viewers—to report at March term.

John A. Phillips, Robert J. Stewart, John N. Boggs, and others, petitioned for change of highway in Craig Township. George W. McKay, William W. Brindley, and William Anderson, were appointed viewers—to report at March term.

Benjamin W. Simmons, Vevay; Frank Scott, Francis M. Graham, Patriot, were granted licenses to retail liquors.

In the matter of petition of Wallace Lamson and others, for change of road near river, in Craig Township. Albert Shaw and Frederick L. Thiebaud, presented to the Board satisfactory evidence that the new road has been opened. The old road ordered vacated and owners of land authorized to take possession of land authorized to take possession of it.

Joseph E. Hart, Auditor elect, Oscar Williamson, Sheriff, and Benjamin L. Simmons, Coroner elect, presented their bonds, which were approved.

John Peak, H. Jack, C. R. Poston, and others, petitioned for a bridge over Bryant’s Creek. William M. Patton was appointed to inspect the old bridge owned by county and stored with Charles Markland, at Markland, and ascertain the probable cost of removing it and placing in position over Bryant’s creek. To report at March term.

William Tait, County Treasurer, presented orders redeemed by him for quarter ending Nov. 30, 1890, amounting to $3,478.80. Also school warrants redeemed by him from Sept. 3, 1889, to Nov. 30, 1890, amounting to $4,922.50. All of which were found correct and cancelled.

George S. Pleasants was employed attorney to brief for Supreme Court case of John L. Thiebaud, Trustee, etc., vs. William Tait, County Treasurer, et al. Auditor ordered to draw order for $20 in favor of Pleasants when brief is completed.

The bid of Dr. George W. VanPelt to perform the duties of County Health Officer for $60 per year, was accepted.

The Auditor presented to the Board a report from the Attorney General of the State stating that from 1867 to 1875, inclusive, showing a net deficit to Congressional School Fund of $912.30. The County Auditor and County Attorney were ordered to examine the matter, and if found as stated by the Attorney General, then the Auditor is ordered to draw an order on county fund for $912.30 in favor of Congressional School Fund interest.

The petitions of improvements of road near Higham’s Corner, and grading of Davis Hill, on Fairview and Cole’s Corner road, both in Cotton Township, were continued until next term.

The bridge over North Branch, near Benj. McIntire’s, was declared unsafe. Trustee of Posey Township ordered to barricade bridge and open road around bridge.

Pleasant, Precinct No. 2, Knox Mill, Jefferson township, was appointed in place of U. P. Craig, who declined to serve. Ira Banta, Precinct No. 4, Edgar House, Jefferson township, in place of Charles McVey—related to candidate. Peter Houze, Fairview Precinct, Cotton Township, in place of C. W. County Business.

Among other business transacted by the County Commissioners was the following:

It was ordered that hereafter no house rent be paid for paupers outside Poor Asylum, and also the assistance, provisions, etc., furnished paupers outside of Poor Asylum, shall be at the uniform rate of $8 per quarter.

In regard to the petition of John Dickason and others, for change of highway near Plum Creek bridge—the object being to straighten road—Wm. R. Protsman, Wm. Satchwell and Daniel Trafelet, viewers, reported they believed change to be of public utility, and laid out the road as changed. The Board granted said change on condition that the petitions pay F. R. Dufour, guardian of John D. Dufour (owner of land through which new road is located), $25 and remove barn to such place as F. R. Dufour may designate.

William Tait, County Treasurer, presented orders redeemed by him for quarter ending August 31, 1890, amounting to $1,781.79. Approved.

In regard to the petition of Wallace W. Lamson and others, for change of road in Craig township, the report of viewers was approved and petition granted—provided that the owners of the land over which the road passes relinquish all claims for damages, except cost of the necessary fencing. Albert Shaw and Justi Thiebaud, being present, relinquished all claim for damages except the cost of the fencing.

It was ordered by the Board that hereafter applicants for school fund loans deposit $5 for necessary expenses, to be refunded when loan is effected. This order made because some persons put the county to expense of appraising land and then do not make loan.
