Switzerland County Commissioners – Mar 1893

Switzerland County, Indiana, Commissioners’ proceedings appeared in:

COUNTY BUSINESS.

At the March session of County Commissioners, among other business transacted, was the following:

Settlements were made with Township Trustees.

Dorwin Marshall was granted license to retail liquor in Florence.

In the matter of the petition of Alfred Wade and others, for change of highway in Posey Township, the viewers had made report at December session. Clara and Alonzo Fisk now remonstrate against said change and claim they will be damaged $300. Luther Buck, Charles Dibble and Salem Bradford were appointed to view said change in road and assess damages and report at meeting of Board tomorrow, Friday, March 24th.

A petition was presented by W. W. Lamson and others asking for change of highway at the mouth of Indian Creek, connecting with lower bridge, so as to abandon road along river and place back near hill. Oscar Williamson, W. O. Marble and John A. Danglade were appointed viewers. Mary A. Mennett and others remonstrated against said change of highway and claim $100 damages. The viewers afterwards reported, March 9th, laying out proposed road, running through lands of Henry P. Sauvain, Helen Shaw, Wm. L. Mennett and Mary Mennett, and recommended old road to be vacated. The remonstrators filed claims for damages as follows: Henry P. Sauvain, $300; William L. Mennett, $50; Mary Mennett, $30; Helen Shaw, $35; and asked that the Board appoint reviewers to view said proposed road and assess damages. The Board appointed the following: Barnhart Schoffner, Wm. R. Protsman and Daniel Trafelet, to report to Board tomorrow, Friday, March 24th.

William Tait, Treasurer, presented to the Board county orders redeemed by him for quarter ending Feb. 28, 1893, amounting to $17,309.28. Also Common School warrants redeemed by him amounting to $9,290.94, and also Congressional warrants amounting to $590.01. All compared with registers and found correct.

Board adjourned March 10th to meet tomorrow, Friday, March 24th.

COUNTY BUSINESS.

The County Commissioners held a special session last Friday to transact business in relation to roads.

In the matter of the petition of W. W. Lamson et al, for change and relocation of highway, Barnhart Schoffner, W. R. Protsman and Daniel Trafelet, reviewers, reported, laying out road as petitioned for, and assessed damages as follows: Henry P. Sauvain, $50; W. L. Mennett, $40; Mary Mennett, $25; Helen Shaw, $20. The Board approved and adopted the report. The Trustee of Craig township was ordered to open up said road (from west end of iron bridge near mouth of Indian Creek) and that he vacate former road. (The object being to remove road from river bank back near hill.)

In the matter of the petition of Alfred Wade and others, for change of highway in Posey township, Luther C. Buck, Charles Dibble, Sr.; and Salem Bradford, reviewers, appraised the damages of Clara Fish at $100. Further action deferred until next term.

In the matter of the petition of A. Z. Stewart and others, for bridge over Bryant’s Creek; deferred until next term.

In the matter of the petition for bridge over Moredock’s Branch; bridge ordered built on condition that the people living in Egypt Bottom open up and dedicate to public use a new highway, beginning at a point where the river road strikes Mary Ann Buck’s west line, and ending at a point in the present road between the house on the land of Abbie North and the Ohio river, said new road to run through the lands of Mary Ann Buck, Luther Buck, Harvey W. Scranton, Cornelius Humphrey, Clara H. North and Abbie North, and the matter is continued until said highway shall have been opened.

Switzerland County Circuit Court – Jan 1893

COURT
Convened last Monday morning, Judge A. C. Downey presiding. Prosecuting Attorney R. L. Davis appeared to represent the interests of the State. He has appointed C. S. Tandy Deputy Prosecuting Attorney for this term of Court, his regular deputy, George S. Pleasants, being temporarily absent.

Monday the Court charged the Grand Jury, and appointed George W. Dorell foreman.

Yesterday the Grand Jury returned an indictment jointly charging with murder Marshal Travis, John Saunders, Albert Penn, Robert Schools (of Ghent, Ky.), Reuben Jones, Perry Andrew (of Vevay). They are charged with killing Oscar Leap, in Vevay, Saturday night, Nov. 5th. Yesterday afternoon the six defendants (all colored) were arraigned before Court, and plead “not guilty.” Their Attorneys asked for a change of venue from the county, which the Court granted, and sent the cases to Jefferson County, where they will come up in Circuit Court at Madison.

Owing to cold weather, the suspension of navigation of river, the absence of two Attorneys attending Legislature, in Indianapolis, several cases have been continued by agreement.

The Petit Jury has not yet been impanelled—because no case yet ready for them to try.

The case of Wesler vs. City of Lawrenceburg, brought here on change of venue, is set for today.

Capt. John B. Coles, of Rising Sun, is the only nonresident attorney who has been in Court—he on Tuesday.

It looks natural to see Lewis F. Works in Court. He was admitted to this Bar in 1868.

The case of Lucy McNutt vs. Frederick Gockel was on change of venue sent to Ohio county.

The case of Laura A. Offerpost vs. Jackson J. Pate; slander. On change of venue sent to Jefferson county.

The Orphan’s Friends Society of Vevay vs. James M. Long et al; on note. Judgment for $451.33.

State vs. James Neal; assault and battery with intent to murder. Dismissed.

David Lee, Administrator of estate of Moses Osborn, deceased, vs. Oliver Osborn; on account. Judgment for $340.

Julia A. Roberts vs. Mary E. Smith et al; partition. Report of George W. McKay, Robert Scott and Joseph Orr, Commissioners, approved.

The Grand Jury visited the County Asylum, and in their report stated there was no “provisions for heating sleeping rooms, sick rooms, etc., provided by the county. We recommend that the County Commissioners give the heating matter their early attention.” They found the county jail secure and comfortable. Having completed their labors the Grand Jury adjourned Saturday evening.

The case of Frederick Wesler vs. City of Lawrenceburg; a civil suit for damages resulting from building levee between coal landing and yards—brought here on change of venue from Dearborn county—has been on trial since last Thursday. The attorneys are: For plaintiff—N. S. Givan, Hugh D. McMullen, W. R. Johnson, George E. Downey, Ward & VanOsdol. For defendant—Warren N. Houck (City Attorney), J. K. Thompson, Geo. M. Roberts, C. W. Stapp, C. S. Tandy.

LATER—This morning the jury brought in a verdict in favor of Wesler for $1,150.

Court adjourned this morning.

Switzerland County Commissioners – Dec 1892

Switzerland County, Indiana, real estate transfers for December 1892 appeared in:

COUNTY BUSINESS.

The County Commissioners—Cornelius D. Green, Geo. W. Sanders and Thomas Montanye (who succeeds William O. Marble, whose term expired)—met Monday, Dec. 5, and adjourned last Friday, 9th.

Among other business transacted by them was the following:

George Clendening was ordered to purchase lumber and repair floor of bridge at Markland.

License to retail liquor was granted to the following persons: Frank Scott, Francis M. Graham, John E. Hudson, Patriot; Benjamin W. Simmons, Vevay.

The Auditor presented a list of taxes refunded to taxpayers in Switzerland county from June 1, 1852 to June 1, 1892, amounting to $2,681.74. The county has received by credits in the various semi annual sheets, from May, 1854, to Dec., 1892 $1,561.41. Leaving a balance of $1,120.33. It was therefore ordered by the Board that said sum of $1,120.33 be entered as a credit in the settlement sheet of 1892.

Amount paid for special Judges from year 1870 to December settlement, 1891, $1,105.00. The State has refunded to county off this amount, from 1870 to December settlement, 1891, $970—leaving the State indebted to the county $135, which amount was ordered deducted from December settlement, 1892.

The above, in regard to refunded taxes and amounts paid special Judges was developed from investigations made by Fleeter & Hunter, which the Auditor compiled and presented to the Board. It only affects accounts with the State and adjustments of county books to correspond.

In the matter of petition of Alfred M. Wade et al for highway in Posey Township, James T. Bodkin, Ephraim Williamson and David Nave were appointed viewers, Dec. 7th to Dec. 9th. The viewers reported the road would be of public utility. Alonzo and Clara Fish filed a remonstrance and the matter was continued until next term.

Benjamin McHenry was appointed to the tree scholarship at Purdue University.

Dr. P. S. Sage was appointed by the Board Secretary of the County Board of Health for the term of one year at $75 per year.

POLICE COURT.

Mrs. Rube Shafer last Saturday was brought before Mayor Manning on a charge of being immoral. She plead guilty and was fined $5, the sentence being suspended on condition she leave town permanently. The Mayor seted for the best, as it is horrible to place a woman in jail, and it is better to permit her to leave town, and reform if she will.

Drinking to excess is the besetting sin of Walter Jennings. Saturday night whiskey got him down, but night policeman Cox got him up—in jail. Monday Mayor Manning fined him $5—While hunting for some one to stay his fine Walter suddenly started out on a Maud S gait. Neither the Marshal or police were silly enough to even try to recapture him, and is hoped that this experience will make him a wiser and better man in his new location.

Last Monday Julius Peelman filed an affidavit with Mayor Manning, acting as a Justice of the Peace, charging William Peelman with shooting with intent. Last Monday William and Julius exchanged four shots, but neither were hit. William is his uncle, Julius being his tenant. All reside in Craig Township. It is a family feud, growing out business of disputes. Deputy Prosecuting Attorney George S. Pleasants appeared for the State. The case was continued until next Monday.

COUNTY BUSINESS.

W. O. Marble, C. D. Green and Geo. W. Sanders, County Commissioners, met Monday, Sept. 5th and adjourned last Thursday, 8th. The following is a synopsis of the business transacted:

Virgil Simpson, an insane person confined in county jail for his own protection, ordered removed to the County Asylum.

Harrold H. Cotton was given the appointment of scholarship at Purdue University.

Peter P. Lewis was appointed a Constable, to fill a vacancy, in Craig Township.

Edward Hawkins, a cripple, was exempt from payment of poll and road tax.

George S. Pleasants was employed County Attorney for one year, at $60.

The case of James M. Gaunt for establishment of Ferry from Lamb, Ind., to Carrollton, Ky., was dismissed.

Taxes were levied as follows: [See newspaper for details.]

William Tait, County Treasurer, presented county orders redeemed by him for the quarter ending August 31, amounting to $9,984.96. He also presented common school and congressional school warrants redeemed by him last quarter, amounting to $5,116.42. All of which were found correct.

Wm. Furnish and George Moore (or Kirtley), of near Markland, were drunk Sunday, and placed in jail by night policeman Jess Cox. Monday morning they were brought before Mayor Manning, plead guilty, and fined $1 each and costs.

Moore stated that while in jail, intoxicated, Newton Short, Wm. Furnish and James Burke stole seven dollars from him. He filed with Mayor Manning the legal charge, in which he described the money: one $1 greenback, two $1 silver certificates, and two silver certificates, $2 each.

He swore out a search warrant, which was served by policeman Jess Cox, assisted by George Rayl, Sam. Lock, Andrew V. Brown and Sheriff Williamson, $5 was found in jail, which Moore identified as his.

In the meantime Furnish had paid fine and gone home. When brought before the Mayor he was told if he would pay the $1 fine the Mayor would throw out costs—the object being to get him out of town without cost of boarding him in jail. Furnish said he would go out and get the $1. He soon returned and handed the Mayor $1 and left town. The Mayor then suspicioned that Furnish had money before leaving his office. Following up this suspicion, he went to Grammar’s saloon and enquired of Lew Peelman if Furnish had been there offering money. Peelman replied that Furnish had been there, bought a glass of beer, and offered in payment a $2 bill, receiving his change. This bill Moore afterwards identified as part of his missing money. An officer was sent for Furnish, who found him at home and brought him before the Mayor. He waived a preliminary examination, and in default of $300 bail was sent to jail.

Tuesday morning Newton Short and James Burk, who are already serving sentences inflicted by Circuit Court, were brought out of jail and arraigned before the Mayor on the charge of stealing money from Moore. They too waived a preliminary trial, and failing to give bail of $300 each, were sent to jail.
